Rwanda Law Sets Fines for Teachers Who
Help Students Cheat in Assessments
Teachers and school support staff in Rwanda
who help learners cheat during examinations or other assessments can face
administrative fines of up to FRW 100,000 for each learner they help cheat,
according to Rwanda’s education law.
The provision is contained in Article
127 of Law N° 010/2021 of 16 February 2021 determining the organisation of
education, published in the Official Gazette on 18 February 2021.
What Does Article 127 Say?
Article 127 addresses cheating or
causing cheating during the assessment of knowledge and skills in basic
education institutions.
According to the law, a teacher or
support staff member of an education institution who is found to have
helped a learner cheat during an assessment commits an administrative offence.
The teacher or support staff member can be
fined:
At least FRW 50,000 and not more than
FRW 100,000 for each learner they helped cheat.
This means that the financial penalty can
increase depending on the number of learners involved. For example, if a
teacher is found to have helped five learners cheat, the potential fine could
range from FRW 250,000 to FRW 500,000.
The Law Applies to More Than National
Examinations
The wording of Article 127 is broader than
cheating in national examinations alone. It refers to assessments of knowledge
and skills and assessments prepared at different levels.
This is important because examination
integrity is not only about protecting national examinations. Schools and
education institutions are also expected to ensure that assessments are
conducted fairly and that teachers and other staff do not facilitate cheating.
Why the Provision Matters
Examination malpractice can undermine the
credibility of learners' results and make it difficult for schools and
education authorities to accurately measure learning outcomes.
By imposing administrative sanctions on
staff who facilitate cheating, the law establishes accountability for adults
involved in assessment malpractice.
The provision also distinguishes between a
learner who cheats and an adult who helps a learner cheat. Teachers and
support staff have a professional responsibility to protect the integrity of
assessments.
What Teachers and School Staff Should
Know
Teachers and examination supervisors should
therefore:
- Follow examination and assessment regulations.
- Avoid giving learners unauthorized assistance.
- Prevent access to unauthorized examination materials.
- Report suspected examination malpractice through the
appropriate channels.
- Maintain confidentiality and fairness during assessments.
- Avoid any action that could give one learner an unfair
advantage over others.
A Reminder About Examination Integrity
in Rwanda
Law N° 010/2021 is the Law Determining
the Organisation of Education and was published as Official Gazette No.
Special of 18 February 2021.
Its Article 127 provides a clear legal
basis for administrative sanctions against teachers and support staff who
facilitate cheating in basic education assessments.
For educators, the message is
straightforward: helping a learner cheat is not simply a breach of
examination rules—it can also result in a financial administrative penalty.
